What an awful predicament to be in, those poor people in the properties in Llanfairfechan having that hanging over them, while the powers that be discuss which option to choose.
Not only that but those people should never have been allowed to move into those properties in the first place. The builder put in an application on the 22/5/2018 to discharge Planning condition 4 as Welsh Water had given approval. Condition 4 states " No dwelling hereby approved shall be occupied until the surface water and foul water drainage facilities have been implemented" etc.
A CCBC consultation response stated Welsh Water have no powers or duties to carry out this role and any approvals from them are not relevant for addressing planning requirements. Then on the 2/7/2018 CCBC planning refused to discharge condition 4 saying the application did not provide enough sufficient details regarding surface water runoff etc generated by the development.
I would have thought all this would have come out in the Conveyancing Search which these residents would have paid good money to their solicitor for and the search is carried out with none other than CCBC and other parties. Part of this search should cover whether a future development would have negative impact on the property such as proposals for new roads or traffic schemes and details of drainage and access rights. Sounds like certain departments aren't singing from the same hymn sheet and those residents have wasted money paying for a search that was worthless
